CONCERNING
QUALITY REQUIREMENTS ON THE SEEDS, LIVESTOCK SEEDS, AND ANIMAL GENETIC RESOURCES

Attachment

Considering:

a. that in order to maintain seed quality standards and/or livestock in order to protect consumers of quality under the Indonesian National Standard (SNI), need to ensure the sustainability of animal genetic resources in a sustainable manner;

b. that follow up the implementation of Article 15 paragraph (4) of Law No. 18 Year 2009 on Animal Husbandry and Animal Health, need to set the Quality Requirements Seeds, Seeds Livestock and Animal Genetic Resources, the Minister of Agriculture;

In view of:

1. Law Number 16 of 1992 concerning Animal, Fish and Plant Quarantine (Statute Book of the Republic of Indonesia Number 56 of 1992, Supplement to the Statute Book of the Republic of Indonesia Number 3482);

DECIDES:

To stipulate:

REGULATION OF THE MINISTER OF AGRICULTURE CONCERNING QUALITY REQUIREMENTS ON THE GERMS, LIVESTOCK SEEDS, AND ANIMAL GENETIC RESOURCES.

CHAPTER I
GENERAL PROVISIONS

Article 1

In this Ministerial Regulation:

1. Livestock germ and/or seed quality requirements are the technical criteria required to livestock germ and/or seed for distribution.

2. Livestock germ hereinafter called as the germ is cattle reproduction material in the form of cement, sperm, ova, sprout egg, and embryo.

3. Livestock seed hereinafter called as seed is livestock that has superior characteristics and inherited superior characteristic and meet specific requirements to be cultivated.

4. Animal genetic resources hereinafter called as Animal SDG is animal or genetic material but does not include fish or its genetic material that contains units that serve as the carrier of heredity, both actual and potential value, which can be used to create a cluster or a new strain.

5. A certificate is a written assurance given by the Certification Institute, Institute for Personnel, Institute for Agricultural Quality Inspection and Product Quality Testing Laboratory accredited or appointed by the Minister of Agriculture stating that the goods, services, processes, systems, or personnel meet the standard of requirements.

6. Certification is a series of giving certificate for goods, services, processes, systems, or personnel.

7. Quality Management System, hereinafter called as SMM is the order of criteria that includes organizational structure, procedures, processes, resources, and responsibilities for implementing quality management.

8. Indonesia National Standard hereinafter called as SNI is technical specifications or something standardized including procedure and method which is based on the consensus of all parties concerned.

9. Breeding value is genetic potential reflection owned by a livestock for certain characteristics are given relative to the position within a population.

Article 2

(1) This regulation is intended as legal basis for:

(2) This regulation aims to make distributed germs and/or seeds fulfill quality standards, and productions as well as export of animal SDG are in accordance with regulation requirements.

Article 3

The scope of this regulation include:

1. Germ and/or Seed Quality Requirements for Domestic Production;

2. Germ and or Seed Quality Requirements that can be imported into the Territory of the Republic of Indonesia, and

3. Animal SGD Quality Requirements that can be exported from the territory of the Republic of Indonesia.

CHAPTER II
GERM AND/OR SEED QUALITY REQUIREMENTS FOR DOMESTIC PRODUCTION

Article 4

(1) The domestic germ and/or seed products circulation in the country must have certificate of viable germ and/or seed.

(2) Certificate of viable germ and/or seed as intended in paragraph (1) shall at least contain information on the genealogy and certain superior characteristics.

(3) Certificate viable germ and/or seed as intended in paragraph (1) issued by an accredited products certification agency or appointed by the Minister.

Article 5

(1) To obtain a certificate of viable germ and/or seed as intended in Article 4 paragraph (1) by the production process in according to quality management system.

(2) Implementing the quality management system as intended in paragraph (1) is done by applying the good germ and/or seed guidelines.

Article 6

(1) The application of the quality management system as intended in Article 5 paragraph (2) is in accordance with the application of ISO 9001:2008.

(2) The germ and/or seed quality requirements must meet the Indonesian National Standard (SNI), as listed in Attachment I, which is an integral part of this Ministerial Regulation.

Article 7

(1) In the implementation of germ/seedling, entrepreneur should fulfill germ and/or seed quality requirements as intended in Article 6 paragraph (2).

(2) In the case of entrepreneur does not meet germ and/or seed quality requirements as intended in paragraph (1), the Minister, Governor or Regent/Mayor in accordance with its authority to provide guidance so that the products can meet the germ and/or seed quality requirements.

CHAPTER III
GERM AND/OR SEED QUALITY REQUIREMENTS CAN BE ENTERED INTO THE TERRITORY OF THE REPUBLIC OF INDONESIA

Article 8

(1) The seed that can be entered into the territory of the Republic of Indonesia may in the form of cement, embryo, egg cell and/or sprout egg.

(2) Seeds that can be entered into the territory of the Republic of Indonesia may be either male and/or female.

Article 9

Entry of germ and/or seed as intended in Article 8 shall meet the quality requirements and accompanied with seed certificate from the country of origin.

Article 10

Quality requirements as intended in Article 9 are proven by a certificate containing the information, as contained in Attachment II that is an integral part of this Ministerial Regulation.

Article 11

(1) Seed certificate as intended in Article 9 contains at least genealogical livestock, photo of animal and breeding value of the desired production characteristics.

Article 12

In the case of importation of germ and/or seed of a new genus or clump, in addition to the requirements as intended in Article 9 must has a recommendation from the Seed Commission.

Article 13

(1) Releasing of germ and/or seed as intended in Article 8 can be done when domestic needs are met.

(2) The fulfillment of the domestic needs of germ and/or seed based on the results of the supply and demand analysis.

CHAPTER IV
ANIMAL GENETIC RESOURCES QUALITY REQUIREMENTS THAT MAY BE RELEASED FROM THE TERRITORY OF THE REPUBLIC OF INDONESIA

Article 14

(1) Releasing of Animal SDG to abroad can be either animal or genetic material.

(2) Releasing of Animal SDG as intended in paragraph (1) may be done if:

(4) Provisions on the releasing of Animal SDG as intended in paragraph (2) for research activities carried out in accordance with the transfer agreement of Animal SDG and regulations.

CHAPTER V
CLOSING PROVISION

Article 15

This Ministerial Regulation shall come into force on the date of promulgation.

For public cognizance, this Regulation of the Minister of Agriculture shall be promulgated by placing it in So that everyone knows, it is ordered that the Minister of Agriculture was promulgated in the State Gazette of the Republic of Indonesia.
